The sentence, again, because this is where it matters most
At the emergency room, at urgent care, before the paperwork:
“This happened at work. This should be a workers’ compensation claim.”
Said, the employer’s insurer is billed and you pay nothing for the necessary treatment. Unsaid, the bill goes to your health plan with your deductible attached, or to you.
On a construction site there is a second reason to say it plainly: the routing question is easier to answer on day one than after a chart has been coded as a personal injury.
Who the employer is
This is the complication specific to the trade: a site can have a general contractor, several subcontractors, a staffing agency and day labor arranged that morning, and “who employs you” is not always a question with an obvious answer.
It does not have to be answered by you. File anyway. The Workers’ Compensation Board’s process exists to sort out which policy responds, and a claim filed on time with imperfect information is in a far better position than a perfect claim filed late.
What helps the claim, gathered the same day if possible:
- the name of the company on the site paperwork, the truck, the permit board or the pay envelope
- the address of the site and the date and time
- the names of anyone who saw it
- a photograph of the site and the condition, if it is safe to take one
Immigration status does not stop a claim
Form C-3 does not require a Social Security number. Every worker injured on the job in New York has the right to file, regardless of immigration status, and the benefits include medical care, cash benefits and death benefits.
We are not going to tell anyone what to do with their own situation — that is a conversation for a free legal services organization, which exists across the city and charges nothing. What is stated here is what the process requires, and that is checkable. What status does and does not affect in health care.
Who is allowed to treat you
Except in an emergency, the provider treating a work injury must be authorized by the Workers’ Compensation Board.
So: in an emergency, go to the nearest emergency room — the rule does not apply and federal law requires screening and stabilization regardless. For everything after, ask before booking: “Are you authorized by the Workers’ Compensation Board to treat injured workers?”
The other half: coverage for everything that is not an injury
Workers’ compensation does not cover being ill, and it does not cover your household.
Union and multi-employer funds. Where you have one, the medical plan and the welfare fund are usually separate, with dental, optical and prescription benefits administered by the fund and claimed separately. Eligibility is often measured in hours worked in a period, so a slow stretch can affect coverage months later. Ask what the threshold is. What to check in a union plan.
Where there is no fund: the Essential Plan at $0 a month up to 200% of the federal poverty level, no deductible, no enrollment season; Medicaid below that; Child Health Plus for children regardless of the child’s status; and NYC Care where status puts insurance out of reach. What the Essential Plan covers · The five-question check.
Paid in cash? Not an obstacle. New York accepts an attestation of income checked against data. How that works.
If a hospital bill arrives anyway
It happens while a claim is being sorted out. Do not pay it to make it stop. Give the billing office the claim information.
And separately, New York’s hospital financial assistance law applies regardless of how the claim resolves: nothing out of pocket at or below 200% of the federal poverty level, no asset test, immigration status may not be considered, applications accepted at any stage. How it works.
Questions people ask
I was hurt on a site. Does my health insurance pay?
It should not have to. Workers’ compensation covers the necessary treatment with no copay, no deductible and no share for you, billed directly to the employer’s insurer.
I do not know which company employs me. Can I still file?
Yes, and you should. The Board’s process sorts out which policy responds. File on time with the information you have rather than late with perfect information.
Can I file without a Social Security number?
Yes. The claim form does not require one, and every worker injured on the job in New York may file regardless of immigration status.
How long do I have?
Thirty days to notify the employer, in writing if possible, and two years to file the claim form with the Workers’ Compensation Board. Telling a foreman is not filing.
Can I see any doctor?
Except in emergencies the provider must be authorized by the Workers’ Compensation Board. In an emergency, go to the nearest emergency room.
What covers me for ordinary illness?
A union welfare fund if you have one, and otherwise the individual market — the Essential Plan at $0 a month up to 200% of the federal poverty level, with no enrollment season.

More in Coverage by the Kind of Work You Do
- Home Care Work: Covering the People Who Do the Covering — For home health aides, coverage depends on who employs you: an agency, CDPAP or a household. What union funds cover, and the thresholds written in hours.
- Several Part-Time Jobs: Full-Time Hours, Nobody's Employee — Work fifty hours across three employers and none of them owes you coverage. The income still adds up for eligibility, and that combined number is usually the good news rather than the bad.
- Seasonal and Temp Agency Work: Who Is Actually Your Employer — With an agency placement, only one of two companies is your employer for benefits. Which one, and why the off-season is when coverage is cheapest.
