The sentence
In the emergency room, at urgent care, at the clinic, said before the registration paperwork:
“This happened at work. This should be a workers’ compensation claim.”
That single sentence changes which entity is billed. Said, the bill goes to the employer’s workers’ compensation insurer. Unsaid, it goes to your health plan — with your deductible and your copay — or to you as a self-pay patient.
Fixing that afterwards is possible and it is work. Saying it at the desk costs nothing.
Why it matters more than it sounds
Workers’ compensation medical benefits are not a discount or an assistance program. The state describes them plainly: medical care to treat a work-related injury or illness is provided at no cost to you, with bills paid directly by the employer’s insurer to the health care provider.
No deductible. No copay. No coinsurance. No “your share”.
That is a better financial outcome than any health plan produces for the same injury, which is why the routing question is the whole game.
Immigration status does not block a claim
This is the part that goes unsaid most often in the workplaces where injuries happen most.
Form C-3 does not require a Social Security number. Every worker injured on the job in New York has the right to file, regardless of immigration status, and the benefits available include medical care, cash benefits and death benefits.
Nothing on this page is legal advice about anyone’s individual circumstances, and anyone who wants advice about their own situation should get it from a free legal services organization rather than from a website. What is stated here is what the claim process requires, which is a different thing and a checkable one. What immigration status does and does not affect in health care.
Who is allowed to treat you
Except in an emergency, the health care provider treating a work injury must be authorized by the Workers’ Compensation Board. That is a real constraint and it surprises people: your regular doctor may not be on the list.
Two practical consequences:
In an emergency, go to the nearest emergency room. The authorization rule does not apply, and federal law requires screening and stabilization regardless of anything else. What emergency care you are entitled to.
For everything after that, ask before booking: “Are you authorized by the Workers’ Compensation Board to treat injured workers?” The Board is the place to confirm who is; we do not publish a list, because it changes.
The order that works
- Get treated. Nothing on this page outranks that.
- Say the sentence at registration: this happened at work.
- Notify the employer in writing within 30 days. Keep a copy with the date.
- File Form C-3 with the Workers’ Compensation Board, within two years. Notifying the employer is not filing.
- Use an authorized provider for everything after the emergency.
- Keep every document: the notice you sent, the claim number, the dates, the names of anyone who saw it happen.
- If a bill arrives anyway, do not pay it on the assumption it is yours. Tell the provider it is a workers’ compensation claim and give the claim number.
If a bill shows up while the claim is being sorted out
It happens, usually because the provider billed the health plan or the patient before the claim was accepted.
Do not pay it to make it stop. Contact the provider’s billing office with the claim information, and contact the Board if the provider will not redirect it.
And separately, if a hospital is involved, New York’s financial assistance law applies to hospital bills regardless of how the underlying claim resolves — nothing out of pocket at or below 200% of the federal poverty level, applications accepted at any stage. It is a second floor under the first. How financial assistance works.
What this page does not cover
Whether to bring a claim, how a dispute over causation is argued, what a settlement is worth, and anything about a specific employer’s conduct are legal questions with real consequences. Free legal services organizations across the city handle exactly this and charge nothing. That is the right first call, ahead of paying anyone.
Questions people ask
Does my health insurance pay for a work injury?
It should not have to. Workers’ compensation covers the necessary medical treatment with no copay, no deductible and no share for you, paid directly by the employer’s insurer to the provider.
What do I have to do first?
Say at registration that the injury happened at work, then notify your employer in writing within 30 days. Missing the 30 days can cost you the right to benefits.
Is telling my supervisor enough?
No. Notifying the employer and filing Form C-3 with the Workers’ Compensation Board are two separate steps, and the form has its own two-year deadline.
Can I file without a Social Security number?
Yes. The claim form does not require one, and every worker injured on the job in New York may file regardless of immigration status.
Can I see my own doctor?
Except in emergencies, the provider must be authorized by the Workers’ Compensation Board to treat injured workers. Ask before booking; in an emergency, go to the nearest emergency room.
A bill came anyway. What do I do?
Do not pay it assuming it is yours. Give the provider’s billing office the workers’ compensation claim information, and if a hospital is involved, apply for financial assistance as well.
