Why the referral matters more here
In most neighborhoods the referral is a formality: there is one obvious hospital and you go to it. Around Fordham there is real choice, which means the referral is a decision someone is making on your behalf, often without saying so.
Two things follow from it. Which network — whether the hospital participates in your exact plan — and which billing entity, because each system runs its own financial assistance process with its own front door.
Neither is visible from the waiting room. Both are answered by one sentence at the moment the referral is written:
“Which hospital system is this being sent to, and is it in network on my plan?”
If the answer produces a hospital your plan does not cover, ask whether the same specialty exists at one that does. That conversation is ordinary and it is far easier before the appointment than after.
Same law, different front doors
Every hospital licensed in New York is bound by the same financial assistance statute and must accept the same state form. What differs is the route in:
- BronxCare runs two intake numbers depending on which site treated you, and publishes the uniform application in English and Spanish.
- Montefiore is a large system where the entity that issued the bill is not always obvious from the letterhead.
- Any other hospital in the state: the state health department publishes financial assistance information hospital by hospital, and that directory is the fastest way in.
The floor that binds every one of them
| Household income | The most a hospital may charge an uninsured patient |
|---|---|
| At or below 200% of the federal poverty level | Nothing out of pocket for medically necessary care |
| 201% to 300% | No more than 10% of the Medicaid rate |
| 301% to 400% | No more than 20% of the Medicaid rate |
Plus: no asset test, immigration status may not be considered, a written decision in 30 days, no lawsuit below 400%, payment plans capped at 5% of monthly income with 2% interest, and 180 days before an account can go to collections.
A policy document that stops at 300% predates the October 20, 2024 amendment and is not current law. Cite the law, ask for the policy in writing, and escalate to the Attorney General’s Health Care Bureau Helpline, 800-428-9071.
Where a refusal can be legitimate
One place, and it is worth knowing precisely because it gets misapplied to bills where it does not belong.
Emergency services: a hospital must offer financial assistance to any patient residing in New York State.
Non-emergency medically necessary services: only to patients residing in its primary service area.
If you are told you are outside the area, two questions follow: “Was this billed as emergency or non-emergency?” and “Which hospital’s primary service area covers my address?” Every geographic part of the state must fall inside at least one. What a primary service area is.
Before the number is even discussed
A self-pay balance usually means no one checked whether a program applied on the day of service:
“Was I screened for coverage for the date of service, and was I screened for Emergency Medicaid?”
The Bronx has one of the highest rates in the city of households that qualify for coverage and are not enrolled, so this question lands here more often than almost anywhere. Coverage you may not have applied for.

How to use this table. It tells you what kind of facility exists and where — not whether they take your plan or accept new patients. Those change constantly and only a phone call settles them. A federally qualified health center charges on a sliding scale by income; a hospital-owned urgent care may add a facility fee; a hospital bills through several entities at once.
Questions people ask
Why does it matter which hospital my referral goes to?
Because each system runs its own financial assistance process with its own office and application, and because networks differ. Ask at the referral, not at the billing desk.
Do all the hospitals use the same application?
Yes. Every hospital licensed in New York must accept the New York State Uniform Hospital Financial Assistance Application. Ask for it by that name.
The hospital’s policy says something different from the law. Which wins?
The law. Policies written before October 20, 2024 are out of date. Put the citation in writing and escalate to 800-428-9071 if the answer does not change.
Can a hospital refuse me because of where I live?
Only for non-emergency care outside its primary service area. For emergency services, assistance reaches any New York State resident.
Is the application available in Spanish?
BronxCare publishes it in English and Spanish, and every hospital must offer it in the primary languages of the patients it serves. Ask for the version you read.
My bill is already with a collection agency. Is it too late?
No. State law accepts financial assistance applications at any stage, including after an account has gone to an agency.
