Why this lands differently here

A medical bill is the same document everywhere. What it can reach is not.

For a household that owns its home, the stakes of letting a hospital bill run — through collections, to a judgment — have always been higher, and the fear of that outcome is itself a reason people pay bills they were never legally required to pay in full.

The useful response is not fear or avoidance. It is knowing, in order, what the law already blocks and which door to use first.

What New York law now blocks

The full set of New York medical debt laws.

The door to use first

Hospital financial assistance, and it is not means-tested in the way people assume:

Household incomeThe most a hospital may charge an uninsured patient
At or below 200% of the federal poverty levelNothing out of pocket for medically necessary care
201% to 300%No more than 10% of the Medicaid rate
301% to 400%No more than 20% of the Medicaid rate

No asset test. A house does not disqualify you, and the hospital may not ask you to sell or borrow against anything. Immigration status may not be considered. The decision must come in writing within 30 days.

And if you have insurance: when out-of-pocket medical costs over twelve months exceed 10% of gross income, the law treats you as underinsured and the same caps apply. How to apply · Finding any hospital’s own policy.

What to do when a collector calls

  1. Do not confirm or dispute the amount on the phone. Ask for the debt to be validated in writing — who the original creditor is, the dates of service, the amount.
  2. Ask whether the account is within 180 days of the first bill. If it is, it should not be with a collector at all.
  3. Apply for financial assistance on the underlying bill, even now. An approved application changes what is owed, which changes what the collector is collecting.
  4. Request an itemized bill from the hospital. Line items, not a total. Duplicate charges and coding errors surface here and it costs nothing to ask.
  5. Do not agree to a payment plan above 5% of monthly income. Say the figure out loud; it is in the statute.
  6. If any of this is ignored, the Attorney General’s Health Care Bureau Helpline, 800-428-9071, takes exactly these complaints. Debt collection rules.

The paper you are handed at registration

Financial responsibility forms are routine and mostly unremarkable. Two things are worth reading before signing:

Anything that commits you to pay whatever the hospital bills is a promise that sits alongside — not above — your statutory rights. Signing it does not waive financial assistance.

Anything described as a guarantor signature makes a second person responsible. Understand who that is before signing on someone else’s behalf, particularly for an adult relative.

If you are asked to sign in a situation where you cannot read it properly, you are entitled to an interpreter and to time. Your language rights.

How to use this table. It tells you what kind of facility exists and where — not whether they take your plan or accept new patients. Those change constantly and only a phone call settles them. A federally qualified health center charges on a sliding scale by income; a hospital-owned urgent care may add a facility fee; a hospital bills through several entities at once.

Questions people ask

Can a hospital take my house over a medical bill?

New York bars hospitals from suing patients with household income below 400% of the federal poverty level, and financial assistance has no asset test — a house does not disqualify you and cannot be required to be sold or borrowed against.

Does medical debt hurt my credit score in New York?

New York has barred providers and their collectors from reporting it since December 2023, though a 2025 federal court ruling clouded enforcement and a collector may argue the point. An entry is still disputable. What definitely does hurt your credit is moving the bill onto a credit card, which strips every protection.

How long before a bill goes to collections?

At least 180 days after the first bill. If a collector contacts you sooner, say so.

Is it too late to apply for financial assistance?

No. Applications are accepted at any stage, including after an account has gone to a collection agency.

The hospital offered a payment plan I cannot afford. Do I have to take it?

No. Payment plans are capped at 5% of monthly income with interest no higher than 2%. A plan above either figure does not comply with the statute.

Where do I complain?

The Attorney General’s Health Care Bureau Helpline, 800-428-9071, handles hospital billing and collection conduct.
